All of us are aware of criminal offences that apply in Australia for the possession and distribution of child pornography and other exploitative material , but what about depictions of consenting adults? Surprisingly, the legal treatment of consensual, non-violent pornography in Australia is quite out of step with community expectations. It is illegal to sell, exhibit or distribute a film or publication that is Refused Classification or would likely be Refused Classification.

Media that has been Refused Classification or would likely be Refused Classification can also not be imported into or exported from Australia. A variety of Federal, State and Territory regulatory offences apply for non-compliance with the classification code. Nevertheless, under the current wording of the Classification Guidelines many forms of adult media depicting non-violent, consensual sex are likely to be Refused Classification by the Classification Board.

Under the Publication Guidelines a publication can be Refused Classification if it depicts:. Mild fetishes include stylised domination and rubberwear. Stronger fetishes include bondage and discipline. The Classification Guidelines have also been used to refuse classification or censor pioneering art-house films that depict real sexual activity or transgress social norms.

There are a handful of adult media production companies currently operating in Australia. However, budding porn producers have to manoeuvre within a stringent and confusing regulatory framework. The ACT has never formally legalised production.

There is much ambiguity regarding adult media production in the ACT, including its relationship to laws covering sex work. Due to the stringency of existing production laws many adult media producers either choose to film their material overseas or act in non-compliance with existing laws.

The eSafety Commissioner is the central agency for regulating internet content in Australia. The Commissioner receives complaints regarding internet content and requests Australian-based internet service providers ISPs to remove content that does not comply with their standards. As a result, many Australian production companies wishing to start an adult website do so via an international server that is not within the jurisdiction of The Commissioner.

Despite the proliferation of pornography on the internet, Australian laws still appear to be trying to outlaw and shelter the public from depictions of non-violent, consensual sex between adults.

Pornography laws by region - Wikipedia

Updated April 12, Depending on who you listen to, I'm either a "happy clappy prude" or blind to just how evil porn really is. Mid last year I set out to confirm stories teenagers were getting seriously injured trying to replicate things they'd seen in online porn. What followed was an unexpected deep dive into Australia's porn industry and a report that reached an inevitable conclusion: we have a problem. As a journalist, I have spoken to people about their experience with every sensitive issue imaginable — from suicide to stillbirths , debilitating illness to domestic abuse — I thought finding people to talk about their porn use would be easy.

Others were genuinely keen to contribute to the conversation — or point me in a direction they thought should be explored. When I did find people willing to talk about their experiences, I was surprised by how large it loomed in their lives. He has since reached a level of self-reflection where he believes he has a problem and is trying to stop watching porn altogether. I don't know if that's weird or not," he said.

James doesn't believe he has a problem or addiction, but can't escape an uncomfortable truth: porn ended his last relationship. His partner had agreed, but on reflection James said it created a point of tension from which the relationship never recovered. It's easy to take a high moral ground against porn, and those who work within it — either as models or producers — don't usually poke their head about the parapet.

And why would they? What they were desperate to convey was, for them at least, the industry had been a nurturing environment that had given them greater confidence in themselves and their bodies. You can argue the toss about whether adults should have unfettered access to online porn or not, and whether this is a freedom of choice issue.

Yet there is a consistent trend of stories that suggest kids are really struggling to make sense of porn and are incorporating into their own sexual relationships in sometimes dangerous ways. Two counsellors who specialise in addiction also told me they were now treating multiple patients for porn use. It seemed to be these points in the original article that the online commentators had the biggest issue with. The line of thinking sounded very much like, "I watch porn and it hasn't affected me, so what's the big deal?

Of course, people pushing back against what they view as anti-porn puritanism is hardly new — as social media site Tumblr found in December when it announced it would no longer host "adult content". The eSafety Commissioner, Julie Inman Grant, is tasked with regulating online porn, but has no power to issue take-down notices to foreign websites hosting violent or objectionable porn, and she doesn't currently direct internet service providers to block it.

The role did get some beefed up powers in the new legislation regarding social media giants , but they are related to extreme and illegal content like rape. Still, Ms Inman Grant is definitely interested in how other countries are legislating for the challenges around mainstream porn. It's also fair to say governments of every persuasion have wrestled with technological changes that have allowed porn to become so incredibly accessible.

A new report commissioned by Communications Minister Mitch Fifield last year into online safety has now been tabled in Parliament. Completed by former Public Service Commissioner Lynelle Briggs, it makes some pretty big recommendations around a range of things from porn to bullying to illegal content. Major change is required," Ms Briggs finds. She recommends boosting staffing in the Office of the eSafety Commissioner to better tackle online issues, and making "significant and wide-ranging changes" to online safety laws.

It also put out a "draft charter" that sets out what the Government expects of digital and social media platforms, including the removal of offensive content. It invited public comment on the charter, particularly from parents and community groups, and submissions closed last week. So as we head into the official election campaign that will be dominated by the bread-and-butter issues like tax and electricity prices, I can't help wonder how either party will address this issue and the public submissions to the charter.

Or will Ms Briggs' report and the subsequent charter be like others before them: assigned to filing cabinets to serve as reminders of action urged but not taken.
